NopeList Terms of Use

NopeList Terms of Use

Effective October 4, 2026

1.Acceptance of these terms

NopeList (the “App”) is provided by DwDrps LLC, a Massachusetts limited liability company (“we”, “us” or “our”). These Terms of Use govern your access to and use of the App. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. We may update these Terms from time to time. If we make material changes, we will update the effective date and, where required, notify you through the App. Continued use after an update means you accept the revised Terms. On iOS, your use of the App is also subject to Apple’s Licensed Application End User License Agreement, which applies in addition to these Terms.

2.What the App does

The App lets you search for restaurants and food establishments and view health inspection results and related information. That information is compiled from inspection records published by municipal and other government health agencies (“Source Agencies”). The App displays inspection information drawn from Source Agency records, and it also uses that information to generate its own ratings and summaries. An App-generated rating is our interpretation of the underlying inspection data. It is not a rating issued, reviewed, or endorsed by any Source Agency, and it may differ from the result the Source Agency itself published. Where available, the App identifies the Source Agency and the date of the inspection the rating draws on. We are not affiliated with, endorsed by, or acting on behalf of any Source Agency. The App is an independent tool.

3.How the ratings are produced

This section describes the material inputs used to produce a rating, how they are weighted, and how the app currently works. It will be updated when that changes.

Only the most recent visit

A restaurant’s color and number come from its latest inspection on file and nothing else. Earlier visits are shown in the history but are not averaged in, and a good record does not offset a bad latest visit. That is deliberately conservative: an inspection describes a day, and the most recent day is the one worth reading.

The color is the outcome the agency recorded

Shown asWhen
CleanThe visit passed and nothing was cited.
CautionThe visit passed, but something was cited.
FailedThe agency recorded the visit as a failure.
UnknownThe result is inconclusive, or there is no inspection on file.

The pass or fail is the agency’s own, not ours. What we decide is only how to present it.

The number is a count, the ranking is a weight

The number on a card is how many things were cited on that visit — a plain count, with nothing weighted.

Wherever the app orders places by how bad they are — the Nopes leaderboards, which pins the map draws, the “avoid” sort, and the worse of two compared places — it uses a severity score instead, so that every use of the word “worst” means the same thing. Each citation on the latest visit contributes according to how the agency classified it:

Agency classificationCounts as
Critical / high risk4
Serious / medium risk2
Minor, or unclassified1

So one critical finding outranks three minor ones. Ties are broken by the number of critical findings, then alphabetically. The four-to-two-one shape follows Los Angeles County’s own deduction bands, which is the closest thing the five jurisdictions have to a common scale.

Which places the map pins

At more than twenty places in view the map draws only the worst twentieth by that same severity score, because four hundred overlapping pins answer nothing. Twenty or fewer and it draws all of them. The cut is taken over what is on screen, so it re-decides as you pan and zoom.

How much history

Two years of visits. Anything older is at the source agency.

What is not an input

No reviews, no ratings from other sites, no popularity, no cuisine, and nothing anyone has paid for. Reader votes on individual citations are shown next to those citations and do not affect any rating, ranking, color or number.

4.Accuracy of inspection data

We take inspection data from public records and present it as published. Inspection records can be delayed, incomplete, corrected after publication, or removed by the Source Agency, and a given result may not reflect a restaurant’s current condition. The App is for general informational purposes only. It is not the official record, and a result shown in the App should not be treated as the final word on a restaurant’s compliance status. Before making a health or safety decision, confirm current information directly with the relevant Source Agency. We do not independently verify, audit, or adjudicate the underlying records, and we are not responsible for the accuracy of the Source Agencies’ own determinations. An App-generated rating is only as current and as accurate as the record it draws on.

5.Differences between jurisdictions

Health agencies do not use a single national inspection standard. Scoring systems, inspection frequency, violation categories, and publication practices vary between jurisdictions. An official result from one city is not directly equivalent to an official result from another, even where the numbers look similar. Where the App presents establishments from more than one jurisdiction together, or sorts or ranks them, it does so using App-generated ratings rather than the Source Agencies’ own scores. Any such comparison is ours, not a government comparison, and it reflects the limits of the underlying data described above.

6.No health, safety, or professional advice

Nothing in the App is medical, health, safety, or legal advice. Use your own judgment when deciding where to eat.

7.Purchases

On iOS, paid features are purchased through your Apple Account and the App Store under Apple’s terms and payment system; on Android, through your Google Account and Google Play under Google’s terms and payment system. We do not collect or store your payment information, and we do not require you to create an account with us to use the App. The day pass, available on iOS only, is a one-time purchase that gives access for 24 hours and then expires automatically; there is nothing to cancel. The monthly plan is an auto-renewing subscription that renews automatically each month unless cancelled before the current period ends. You can manage or cancel the monthly plan on iOS in Settings › your name › Subscriptions, and on Android in Google Play’s subscription settings.

8.Crowd verdicts

A vote on a citation says how that citation reads to you. It is an opinion offered to other readers, not a claim about the restaurant, and it can be undone at any time. Do not use it to make statements about a business you could not otherwise make. We may remove any vote and may suspend or discontinue this feature at any time.

9.Location services

If you enable location access, the App uses your device’s location to find restaurants near you. You can allow, deny, or later change this permission in your device Settings. Denying location access limits the App to search that does not depend on your location. How location data is handled is described in our Privacy Policy. On Android, maps are provided by Google Maps. Your use of Google Maps features is subject to the then-current Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

10.Acceptable use

You agree not to use the App for any unlawful purpose or in violation of these Terms; attempt to reverse engineer, decompile, or derive the App’s source code; scrape, harvest, or systematically extract content from the App for republication or resale; interfere with or disrupt the App’s operation or servers; or present information taken from the App as an official government record.

11.Intellectual property

The App’s software, design, original text and graphics, and the protectable selection, organization, and presentation of the information it displays are owned by us or our licensors and are protected by applicable intellectual property laws. Underlying inspection records and the facts they contain remain subject to their own legal status as public records and are not claimed by us. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on a device you own or control, for personal, non-commercial purposes.

12.Disclaimers

THE APP AND ALL CONTENT IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT INSPECTION DATA WILL BE ACCURATE, COMPLETE, OR CURRENT. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

13.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY CLAIM ARISING FROM (A) A DECISION YOU MAKE BASED ON INFORMATION OR RATINGS SHOWN IN THE APP, OR (B) ANY ERROR, INACCURACY, OMISSION, OR DELAY IN THE INSPECTION INFORMATION OR APP-GENERATED RATINGS DISPLAYED. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14.Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the App or your violation of these Terms.

15.Advertising

The App does not display third-party advertising. We may introduce advertising in the future. If we do, we will update these Terms and our Privacy Policy to describe how advertising partners operate and what data, if any, they receive.

16.Reporting an error in displayed information

If you are a restaurant or other establishment and believe the App is showing information about you incorrectly, write to us at info@dwdrps.com. That address is for errors in how the App matches, presents, or rates information — an inspection record matched to the wrong establishment, a location that has closed, a record we are showing after the Source Agency has published a newer one, an App-generated rating calculated from the wrong or an outdated record. Those are ours to correct, and we will review reports of them. What we cannot do is change what a Source Agency published. We do not hold or edit the underlying records, and we do not adjudicate the substance of an agency’s findings. If you disagree with the inspection result itself, that has to be raised with the Source Agency that issued it. We may update the App to reflect corrections the Source Agency publishes. We review reports received at this address and correct confirmed errors. We do not commit to a particular response time. This also covers a vote on a citation that you believe is being used to make a claim about your establishment; we may remove it under Section 8.

17.Termination

We may suspend or discontinue the App, or your access to it, at any time. You may stop using the App and delete it from your device at any time.

18.Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
